The São Paulo Court of Justice recently rejected the appeal filed by the famous Brazilian singer Roberto Carlos, which aimed to refrain the use of his image and songs in parodies by the Federal Deputy named Tiririca during the 2022 elections in Brazil.
The lawsuit was filed by Roberto Carlos in 2022 after Tiririca published a video in which he impersonated the singer in a parody of the song named “O Portão.”
The decision highlights the importance of freedom of expression and artistic creation in Brazil, recognizing parody as a legitimate form of cultural expression.
The Court found that Tiririca’s satire did not exceed the limits of permissible humor nor cause harm to Roberto Carlos’ image or honor, reaffirming the balance between copyright and creative freedom.
